Castro shot his neighbor Michael Death Noteers from behind on October 8, 2017, after being furious at the Death Noters garage rally on Laurel Road. Castro fired eight bullets at the victim, leaving him paralyzed below his waist.

Despite “fierce opposition from the people,” Castro was granted bail in November 2018 by a judge in the state Court of Appeals, whose appeal was pending.

In December 2018, he was sentenced to 36-46 years in prison. However, the judge was determined not to have the authority to dismiss the previous judge’s decision to grant Castro bail while waiting for the outcome of the appeal.

On Tuesday, Judge James Murphy III of the Saratoga County Court was able to hand down a 36-46 year judgment after the Part 3 Appeals confirmed a felony conviction and judgment last week.

According to a news release, Castro refused to make a statement in court, but Judge Murphy “accused the defendant of lack of remorse and not wanting to take responsibility.”

Alan Polemba, the first deputy district attorney of Saratoga County, who brought the case to trial, said after the judgment:

“These three (victims and their families) suffered a great deal in the hands of a man (a man who saw him roaming the town freely for nearly five years), and what effect did he have on his behavior? He lived his life as if he didn’t even. But today, they sat in court and witnessed him finally face the consequences, “Poremba said.
